Fee Structure -Terms and Conditions

Thank you for using the service of Placing Heads Recruitment. Our efforts are concerned with meeting your human resource needs and maximising the productive potential of employment candidates. Herewith please find the schedule of fees applicable for the RECRUITMENT Code by ourselves on behalf of your company:

Fee Structure

Placing Heads placement fee is based on the annual gross remuneration (including superannuation, commission/bonus, car allowance and tools of the trade) of the candidate which is currently at a rate of 10%.

Terms and Conditions

1. Appointment by the client of any applicant introduced or referred by Placing Heads shall be construed as an acceptance by the clients of the terms and conditions herein mentioned.

2. CONFIDENTIALITY

2.1. All information and documentation concerning an applicant is furnished to the client in the strictest of confidence and on the specific condition that:

2.2. No information is to be divulged by the client to anyone for whatsoever reason without obtaining the applicant’s prior written consent thereto; and

2.3. The client shall not be entitled or authorised to contact, for whatsoever reason, the candidate’s employer, without obtaining the applicant’s prior written consent thereto.

2.4. Your company will be held liable for any damages or injury that may arise out of such breach of confidence.

3. The recruitment fee, calculated in accordance with the above mentioned fee structure, shall be due and payable by you to Placing Heads within fourteen (14) days of the commencement date of the candidate’s employment with you.

4. The fee payable by you to Placing Heads shall be calculated as a percentage of the annual gross remuneration of the candidate in accordance with the following definition:

GROSS ANNUAL REMUNERATION

“Gross annual remuneration” shall include but not be limited to all salary, superannuation, commission, fee or allowance payable or paid by you to the candidate and shall in addition specifically include all taxable benefits.

5. In the event of any applicant being offered and accepting any work from the client within a period of twelve (12) months of being introduced to the client, the appropriate fee, calculated in accordance with the above fee structure, shall become due and payable by the client to Placing Heads. Work in this sense is defined as work of any nature, whether permanent or temporary, direct or indirect.

6. A copy of the candidate’s letter of appointment and full details of the terms of employment shall be made available to Placing Heads within seven (7) days of the candidate’s date of employment.

7. Whilst every care has been taken by Placing Heads in the screening, selection and in reference checking of the candidate wherever possible, the final selection and appointment of any candidate remains with the sole discretion and responsibility of the client.
8. In the event of the appointment being terminated within the guarantee period, for reasons other than retrenchment or redundancy, Placing Heads shall endeavour to provide a replacement to you free of charge, within a reasonable period of time. Under no circumstances will a cash refund be paid to you by Placing Heads. The full placement fee remains due should a candidate be made redundant or retrenched during the guarantee period.

9. In addition, the guarantee referred to above shall be of no force and effect whatsoever should the client fail to: Pay the full fee due to Placing Heads and / or notify Placing Heads in writing of the termination of employment of the candidate within fourteen (14) days of the date thereof.

10. The client releases Placing Heads Recruitment, its related bodies corporate and their officers, Directors, employees, personnel and agents from any claims, losses, damage or expenses suffered or incurred by the client arising from or any way connected with Placing Heads Recruitment seeking candidates for the client or the introduction by Placing Heads to the client of any candidate or the engagement of any candidate by the client.

11. The terms and conditions herein contained constitute the entire contract between you and Placing Heads and no variation, deletion or alteration shall be binding or have any effect whatsoever unless the same has been reduced to writing and signed by both parties. Should the client breach any of the terms and conditions hereof, or fail to effect payment of the recruitment fee within thirty (30) days of the placement of the applicant, and should Placing Heads institute legal action against the client, the client shall be liable for all legal costs on the scale as between Attorney and Own Client.
